NOTICE UNDER THE PERSONAL DATA PROTECTION ACT 2010
NOTIS DI BAWAH AKTA PERLINDUNGAN DATA PERIBADI 2010

The Personal Data Protection Act 2010 (the “Act”), which regulates the processing of personal data in commercial transactions, applies to Eco Community Sdn Bhd. For the purpose of this written notice (“Notice”), the terms “personal data” and “processing” shall have the same meaning as prescribed in the Act.
Akta Perlindungan Data Peribadi 2010 (“Akta” tersebut) yang mengawal selia pemprosesan data peribadi dalam transaksi komersial, terpakai kepada Eco Community Sdn Bhd. Untuk tujuan notis bertulis ini (“Notis”), terma-terma “data peribadi” dan “pemprosesan” mempunyai maksud yang sama seperti yang ditakrif dalam Akta tersebut.

1. This Notice serves to inform the User that the User’s personal data is being processed by Eco Community Sdn Bhd or on Eco Community Sdn Bhd ‘s behalf.
Notis ini bertujuan untuk memaklumkan kepada anda (“Pengguna”) bahawa data peribadi Pengguna sedang diproses oleh Eco Community Sdn Bhd atau bagi pihak Eco Community Sdn Bhd.

2. The User’s personal data includes the information provided by the User in the documents prescribed in paragraph 4 of this Notice and all other personal data Eco Community Sdn Bhd again collect from the User on any subsequent occasion.
Data peribadi Pengguna termasuk maklumat yang diberikan oleh Pengguna dalam dokumen yang dinyatakan dalam perenggan 4 Notis ini dan semua data peribadi lain Eco Community Sdn Bhd sekali lagi kumpul daripada Pengguna pada bila-bila masa kemudiannya.

3. The User’s personal data is being or is to be collected and further processed for processing Eco Community Sdn Bhd ‘s purchase order and the User’s invoice (or the User’s company invoice, if applicable); communicating with the User; responding to the User’s enquiries; conducting market surveys and trend analysis; conducting internal activities; credit assessments and such other background checks as Eco Community Sdn Bhd may determine to be necessary or appropriate; conducting other legitimate business activities; complying with any legal or regulatory requirements; and such other purposes directly related to the foregoing (collectively, “Purposes”).
Data peribadi Pengguna sedang atau akan dikumpulkan dan diproses selanjutnya untuk memproses pesanan belian Eco Community Sdn Bhd dan/atau invois Pengguna; berhubung dengan Pengguna; menjawab pertanyaan Pengguna; menjalankan aktiviti pemasaran dand promosi; menjalankan tinjauan pasaran dan analisis kecenderungan; menjalankan aktiviti dalaman; penilaian kredit dan semakan latar belakang lain sepertimana Eco Community Sdn Bhd anggap perlu atau sesuai; menjalankan kegiatan-kegiatan perniagaan sah lain; memenuhi apa-apa kehendak undang-undang atau kawal selia; dan maksud-maksud lain yang berhubungan secara langsung dengan yang tersebut di atas (secara kolektif, “Maksud-maksud” tersebut).

4. The User’s personal data is being or is to be collected from the business card and other written details of the User’s employees, staff and agents; the User’s invoice (or the User’s company invoice, if applicable); credit reporting agencies, background check agencies, and/or other third party service providers; and information that the User have provided and will provide Eco Community Sdn Bhd from time to time.
Data peribadi Pengguna sedang atau akan dikumpulkan daripada kad perniagaan dan butir-butir tertulis lain pekerja, kakitangan dan agen Pengguna, invois Pengguna, agensi pelaporan kredit, agensi pemeriksa latar belakang, dan/atau pihak pembekal perkhidmatan ketiga yang lain; rakaman televisyen litar tertutup (CCTV) Eco Community Sdn Bhd; dan maklumat yang Pengguna telah berikan dan akan berikan Eco Community Sdn Bhd dari masa ke semasa.

5. The User has the right to request access to and to request correction of the User’s personal data and to contact Eco Community Sdn Bhd with any inquiries or complaints in respect of the User’s personal data (including the possible choices and means for limiting the processing of the User’s personal data) by sending an email to hello@eCommunity.my .
Anda berhak untuk meminta akses kepada dan meminta pembetulan terhadap data peribadi Pengguna dan untuk menghubungi Eco Community Sdn Bhd tentang apa-apa pertanyaan atau aduan berkenaan dengan data peribadi Pengguna (termasuk pilihan-pilihan dan cara-cara yang mungkin untuk mengehadkan pemprosesan data peribadi Pengguna) melalui email kepada hello@eCommunity.my.

6. Subject to provisions of the Act:
Tertakluk kepada peruntukan-peruntukan Akta tersebut:

(a) the User may, upon payment of a prescribed fee, make a data access request in writing to Eco Community Sdn Bhd; and
Anda boleh, apabila dibayar fi yang ditetapkan, membuat suatu permintaan mengakses data secara bertulis kepada Eco Community Sdn Bhd; dan
(b) Eco Community Sdn Bhd may refuse to comply with a data access request or a data correction request and shall, by notice in writing, inform the User of Eco Community Sdn Bhd refusal and the reasons of Eco Community Sdn Bhd refusal.
Eco Community Sdn Bhd boleh enggan mematuhi permintaan mengakses data atau permintaan pembetulan data dan hendaklah, melalui notis bertulis, memaklumkan Pengguna mengenai keengganan tersebut dan sebab-sebab bagi keengganan tersebut.

7. Eco Community Sdn Bhd disclose or may disclose the User’s personal data to Eco Community Sdn Bhd ‘s related corporations, Eco Community Sdn Bhd’s business partners, Eco Community Sdn Bhd ‘s service providers, governmental departments and/or agencies, regulatory and/or statutory bodies and any such third party requested or authorized by the User for the Purposes.
Eco Community Sdn Bhd menzahirkan atau boleh menzahirkan data peribadi Pengguna kepada perbadanan berkaitan Eco Community Sdn Bhd, rakan-rakan perniagaan Eco Community Sdn Bhd, pembekal-pembekal perkhidmatan Eco Community Sdn Bhd, jabatan-jabatan dan agensi-agensi kerajaan, badan-badan kawal selia dan / atau berkanun dan dan mana-mana pihak ketiga yang diminta atau dibenarkan oleh Pengguna untuk Maksud-maksud tersebut.

8. Eco Community Sdn Bhd may require the User’s assistance if the personal data relating to other persons is required to process the User’s personal data for the Purposes and the User hereby agree to use the User’s best endeavors to assist Eco Community Sdn Bhd when required.
Eco Community Sdn Bhd boleh menghendaki bantuan Pengguna jika data peribadi yang berhubungan dengan orang lain dikehendaki untuk memproses data peribadi Pengguna untuk Maksud-maksud tersebut dan Pengguna dengan ini bersetuju untuk menggunakan usaha terbaik Pengguna untuk membantu Eco Community Sdn Bhd bila dikehendaki.

If the User gives Eco Community Sdn Bhd personal data or information about another person, the User confirms that he/she has appointed the User to act for him/her, to consent to the processing of his/her personal data and to receive on his/her behalf any data protection notices.
Jika Pengguna memberi Eco Community Sdn Bhd data peribadi atau maklumat yang berhubungan dengan orang lain, Pengguna mengesahkan bahawa orang tersebut telah melantik Pengguna untuk mewakilinya, memberi kebenaran untuk memproses data peribadinya dan untuk menerima sebarang notis perlindungan data bagi pihaknya.

9. If the User fails to supply Eco Community Sdn Bhd any of the User’s personal data, Eco Community Sdn Bhd may refuse to process the User’s personal data for any of the above Purposes.
Jika Pengguna gagal untuk memberikan Eco Community Sdn Bhd mana-mana data peribadi dan, Eco Community Sdn Bhd boleh enggan untuk memproses data peribadi Pengguna untuk mana-mana Maksud-maksud tersebut.

10. Eco Community Sdn Bhd may transfer the User’s personal data to a place outside Malaysia.
Eco Community Sdn Bhd boleh memindahkan data peribadi Pengguna ke sesuatu tempat di luar Malaysia.

11. The User is responsibles for ensuring that the information the User provides Eco Community Sdn Bhd is accurate, complete, not misleading and is kept up to date.
Anda bertanggungjawab untuk memastikan bahawa maklumat yang Pengguna berikan Eco Community Sdn Bhd adalah tepat, lengkap, tidak mengelirukan dan terkini.

12. In the event of any inconsistency between the English version and the Bahasa Malaysia version of this Notice, the English version shall prevail over the Bahasa Malaysia version.
Sekiranya terdapat apa-apa ketidak-konsistenan antara versi bahasa Inggeris dan versi Bahasa Malaysia Notis ini, versi Bahasa Inggeris akan mengatasi versi Bahasa Malaysia.
